Anyone travelling on cycle paths, especially in urban areas, is probably familiar with parking offenders. But is it legal to take a photo of the traffic offender?

Is it permitted to photograph incorrectly parked vehicles and forward these photos to the police as part of a report? The Bavarian State Office for Data Protection Supervision (LDA) said "no" and issued warnings. The Ansbach Administrative Court has now disagreed and did not consider the photos to be an offence against data protection.

The case was brought by two men from Munich who had been reporting parking offences on footpaths and cycle paths for years. The judgement could also give a boost to the "Wegeheld" app and the weg.li website, which can be used to report parking offences.
